Description
This circular is for the attention of local authorities, voluntary sector organisations, relevant social work and health professional bodies and NHS Boards. It updates some sections of the Direct Payments Policy and Practice Guidance (the 2003 Guidance) to extend eligibility for direct payments to the first non-disabled care group of older people aged 65 and over who are assessed as needing community care services due to infirmity or old age. This is by virtue of Community Care (Direct Payments) (Scotland) Amendment Regulations 2005 (SSI 2005/114) which take effect from 1 April 2005.

The circular also revises paragraphs 80 and 81 of the 2003 Guidance on employing close relatives, spouses and partners. The updated guidance reflects the present law which is provided in regulation 4 of the Community Care (Direct Payments) (Scotland) Regulations 2003 (SSI 2003/243) (the 2003 Regulations) and section 12B(3) of the Social Work (Scotland) Act 1968
